Facebook’s Mark Zuckerberg May Have His Eyes on Politics

Earlier this year Facebook’s board of directors was sued after investors claimed that they were not working in their favor. The lawsuit stems from the fact that the Facebook’s board of directors allowed the company’s CEO, Mark Zuckerberg, to sell a majority of his shares but, still maintain majority control and voting rights in the social media company.

According to reports, court filings show that text messages sent by Facebook board member Marc Andreessen suggest he was working in favor of Zuckerberg. Private messages including “this line of argument is not helping” have given several investors the impression he was helping the CEO instead of working on behalf of investors.

Zuckerberg holds a majority share of Facebook voting rights. At the time, Zuckerberg wanted to sell off shares of his stock in order to fund his Chan Zuckerberg Initiative, a program that makes investments to fund two major goals “advancing human potential and promoting equal opportunity.” But, he did not want to lose voting control in Facebook. Consequently, Zuckerberg suggested creating a new class of stock for himself, to make that happen.

Three board members were then put in place to represent investors. They were put in place to decide whether Zuckerberg’s request was fair to investors and shareholders. Ultimately, the special committee agreed in favor of Zuckerberg’s new class of stock granting Zuckerberg the opportunity to sell $32.7 billion in stock.

With that being said, the lawsuit argues that the new type of stock actually diluted shareholder’s power and votes over the future of Facebook.

Marc Andreessen was one of the board members selected to be a part of the special committee. Andreessen, who was the cofounder of Netscape and later became a Silicon Valley investor, is accused of engaging in a conflict of interest, asserting he coached Zuckerberg while serving on the special committee.

The text messages shared details about the possibility of Zuckerberg working in the government while still retaining control of Facebook. Andreessen texted Mark Zuckerberg in March on how to maintain a balance between government service and Facebook saying: “how to define the gov’t service thing without freaking out shareholders that you are losing commitment,” one text sent by Andreessen said.

Andreessen later texted, “I think the biggest remaining issue is still around the government service.”

News of Zuckerberg engaging in politics is not new. In the past, Zuckerberg argued for worldwide access to faster internet. In addition, Mark Zuckerberg hosted a fundraiser for Donald Trump supporter, former head of Trump’s transition team and governor of New Jersey Chris Christie. Also, Zuckerberg previously donated $100 million towards Newark’s school system.

But, Zuckerberg’s ties to politics extend beyond his commitments to faster internet access and higher quality education in the Newark’s classrooms. One of Facebook’s board members, Peter Theil is reportedly bringing Silicon Valley colleagues to meet with Donald Trump’s transition. It is important to note that Theil gained national attention after reports surfaced he was the secret bankroller behind the lawsuit that forced Gawker into bankruptcy, was also a Republican National Convention keynote speaker and avid supporter of Donald Trump, telling the world during the RNC: “When Donald Trump asks us to Make America Great Again, he’s not suggesting a return to the past. He’s running to lead us back to that bright future.”

Google’s Pixel Phone Gaining Share in Pre-Holiday Sales

Sales of Google’s latest smartphone, Pixel, kicked off well in pre-holiday sales following the phone’s release in October.  All told, both Pixel models accounted for roughly 0.5% of phone sales in the U.S. for the period ending on October 31.  While the sales data does not sound impressive when compared to that of Apple or Samsung, the Pixel results helped Google to pull even with sales of Microsoft’s flagging smartphone and Chinese handset maker Huawei.

Another point which is could be overlooked by some is that the Pixel was not released until October 20.  This means that the published sales totals were achieved in 11 days, compared to three months for the other brands.  Director of Global Consumer insights at Kantar, Lauren Guenveur, noted that Apple sold nearly 41% of the new phones over the same period.

Based on estimates, Google should sell between 3 to 5 million new phones in the Fourth quarter – Apple is expected to sell nearly 80 million iPhones in the same period.  What is interesting for industry analysts is whether Google’s latest smartphone entry will continue to gain share in the market.  If so, the this could complicate the internet company’s relationship with other handset makers such as LG and Samsung who rely on Google’s Android operating system to power their devices.

The Pixel is the seventh-generation smartphone released by Google and was manufactured by Taiwanese handset maker HTC. While the fact that Google has released previous smartphones does not raise any red flags with the company’s Android partners, the aggressive marketing may ruffle some feathers.

The segment has been something which Google has always shown an interest. In 2012, the company acquired Motorola and its patents for $12.5 billion and many industry analysts felt that would be used to compete head-to-head with Apple.  However, the Motorola acquisition never amounted to much and in 2014, the company sold Motorola to Lenovo for $2.9 billion.

As mentioned, Google released two models of the Pixel phone in late-October – a 5-inch and a 5.5-inch version.  Since then consumers have been flocking to the phones due to the number of added features they offer such as the voice-activated personal assistant and Qualcomm’s Snapdragon 821 chip, which is one of the fasted on the market. Reviewers also scored the phone quite highly, comparing some of the features to Apple’s iPhone 7.

An exclusive distribution deal with Verizon has also aided sales of the Pixel as subscribers of competing cell networks needed to switch carriers or purchased the phones from Best Buy or directly from Google. One thing which is not known is whether the company will continue to sustain the marketing campaign, which helped to raise awareness.  Industry analysts say that the company may have spent $100 million or more as part of the Pixel marketing campaign and an open question is whether sales will continue to grow without the marketing support.

Shares of Google closed up 1.8% at $809.45 on Friday.

Toys Accused of Spying on Children

My Friend Cayla dolls and I-Que Intelligent Robot toys are recording children and putting them at risk, according to a consumer watchdog group.

The Electronic Privacy Information Center (EPIC) teamed up with the Commercial Free Childhood, the Center for Digital Democracy and the Consumers Union to file a complaint with the Federal Trade Commission over the toy’s ability to spy on children.

My Friend Cayla and I-Que Robot, which are manufactured by Genesis Toys, use technology that is responds to person’s voice. The toys were designed to allow for a child to talk to the toy, and the toy would talk back. Behind the scenes, the toy would record what the child has said, convert that information into text, and via the Internet, the toy would respond back to the kid. The voice-recognition software program used to make this happen is called Nuance – a program that is used by the military and intelligence agencies.Consumer watchdog groups argue in their complaint that Genesis Toys does not obtain consent from parents prior to collecting data of children’s voices. And that is a violation of the Children’s Online Privacy Protection Act, according to the complaint.

“Both Genesis Toys and Nuance Communications unfairly and deceptively collect, use, and disclose audio files of children’s voices without providing adequate notice or obtaining verified parental consent,” Epic complaint says.

The FTC complaint also argues that Genesis failed to provide security measures to prevent people from eavesdropping on children’s conversation and that “creates a substantial risk of harm because children may be subject to predatory stalking or physical danger.”

The executive director of the Campaign for a Commercial Free Childhood, Josh Golin, released a statement against Genesis toys arguing that children form personal relationships with their toys therefore, it is important the data that is collected “not be used for manipulative and sneaky marketing.”

The complaint also argues that the toy is used as a way to sell products to young children.

“My Friend Cayla is pre-programmed with dozens of phrases that reference Disneyworld and Disney movies. For example, Cayla tells children that her favorite movie is Disney’s The Little Mermaid and her favorite song is ‘Let it Go,’ from Disney’s Frozen. Cayla also tells children she loves going to Disneyland and wants to go to Epcot in Disneyworld.”

COPPA requires websites or online services directed to kids under the age of 13 to give parents more control over the information websites are able to collect from their kids. The rule was placed in effect three years ago and provides additional protections and regulations companies need to follow.

The My Friend Cayla doll and I-Que Intelligent Robot toy are currently for sale at Amazon for $59 and $126, respectively. Released in 2015, the first My Friend Cayla doll sold millions of dolls.

Why Netflix Might Be in Trouble

The stock market is currently on a high which we have not seen since the dot-com days of the 1990’s.  Dow 20,000 is no longer out of the realm of possibility – currently at 19,664 – and the exuberance on Wall Street is palpable.

However, Netflix may end up left out in the cold. The company, which killed blockbuster and is doing its best to kill cable TV, seems like an odd candidate to be the ugly duckling.  But if the Federal Communications Commission (FCC) changes its stance on net neutrality, it is could end up having a profound impact on the company’s financial position.

Net Neutrality is a concept where internet service providers (ISP) must treat all the information on their networks equality. In this case, neutrality means impartiality. Per the findings of Global Internet Phenomena Report, content providers like Netflix, YouTube, and Amazon Prime Video account for more than half of all internet traffic in the U.S.

This is a big deal to companies such as AT&T, Comcast, and Time Warner who are the nation’s largest ISPs. These companies view video streaming sites as a burden on their networks and they openly complain about the fact that Netflix and others do very little to pay for network upgrades, which help to make their content available to millions of users.

This brings us back to the FCC, which ruled in early-2015 that the internet will remain open for the time being. The decision was hailed by a coalition of technology companies (Netflix, Google, Amazon, Facebook) and consumer advocates. But then came the Election of 2016, which according to industry analysts means Net Neutrality could once again come up for review.

This is especially true as the presumptive President-Elect’s picks to the FCC come from the telecoms industry. In previous comments on the issue, Jeff Eisenach and Mark Jamison have voiced their opposition to net neutrality. In fact, Mr. Eisenach even went so far to label the concept a form of ‘crony capitalism’.

While the U.S. remains the largest market for Netflix, a reversal on Net Neutrality would impact the company in four ways.  First, it would have an almost immediate impact on the quality of service users enjoy. Second, this could lead to higher monthly subscription rates, which could drive an exodus of subscribers. Third, higher costs would lead to lower profits. Four, many countries may take the FCC’s lead and adopt similar rules regarding Net Neutrality. If this were to happen then companies like Netflix would be facing a dramatically altered landscape, one which may threaten the growth of their industry.

Whether one believe the debate over Net Neutrality is a question of consumer rights or crony capitalism, the reality is that the fight is really between two multi-billion dollar industries (technology and communications) over who will control the profits in this space.

Shares of Netflix were trading down .64% on Friday morning at $122.57.

Memory and Fear Affected By Breathing Rhythm, Study Says

Researchers at Northwestern University have discovered the way people breathe has an impact on their memory and fear response. And it all depends on whether you are inhaling or exhaling through your nose.

Published in the “Journal of Neuroscience” lead author and professor of neurology, Jay Gottfried, discovered individuals were able to remember something if they see an object while they inhaled versus when they exhaled. However, the difference in memory was negated if the individual was breathing through their mouth.

In addition, researchers revealed that fear responses was also impacted by inhaling through the nose. To test emotional judgement, researchers asked test subjects to look at several different faces. The results of the study showed subjects were more likely to identify a fearful face, if they saw the face while they were inhaling in comparison to exhaling.

How did researchers at Northwestern University make this discovery? It all started with epileptic patients. Seven individuals diagnosed with epilepsy were to undergo brain surgery. Prior to the surgery, neurosurgeons implanted a device to measure the electrical activity inside the patient’s brain to determine the reason why the seizures were taking place.

That is when researchers made a discovery, electrical activities in the brain’s amygdala, which is known for regulating fight or flight responses in humans and animals, and the hippocampus, which is associated with memory function, changed based upon the patient’s breathing rhythm.

Researchers then analyzed the breathing rhythms and their fear response of sixty subjects. Scientists showed pictures of faces with different facial expressions. Meanwhile, researchers recorded their breathing rhythm. When the test subjects encountered a picture of someone who is afraid, they were more quickly to identify that picture when they inhaled in comparison to when they exhaled.

In order to test the hippocampus and the relationship between breathing and memory, the same subjects were then shown pictures of objects and then asked to recall those objects. Researchers discovered the subjects were more likely to remember the object if they saw it while they inhaled in comparison to when they exhaled.

Ultimately, Northwestern University researchers argue that rapid-breathing could help with memory and emotional responses in treacherous situations.

2016 Ends With Two Major Dinosaur Fossil Discoveries

Paleontologists have discovered a feathered dinosaur tail inside a piece of amber.

While, this is not the first time scientists have discovered dinosaur feathers, this dinosaur tail is in incredible condition. The discovery was reported in the journal of “Current Biology” and illustrates the details of dinosaur feathers and how dinosaurs evolved over time.

University of Geosciences in Beijing researcher, Lida Xing, is the lead author of the study. Xing revealed that the specimen was found in Myanmar at a market. People were selling the pieces of amber reportedly explaining the amber contained some type of prehistoric plant and would make for an interesting piece of jewelry. However, Xing was able to recognize the details within the amber as a piece of prehistoric history. Xing contacted Royal Saskatchewan Museum researcher Ryan McKellar to research the new discovery.

Together the research team used technological instruments to analyze the piece of amber in extreme detail. Researchers argue that the feathered tail belonged to a coelurosaur – a carnivorous dinosaur that existed 99 million years ago.

In a statement, McKellar explained “The material preserves a tail consisting of eight vertebrae from a juvenile; these are surrounded by feathers that are preserved in 3D and with microscopic detail.”

Xing and McKellar are now looking for more fossils preserved in amber. “Amber pieces preserve tiny snapshots of ancient ecosystems, but they record microscopic details, three-dimensional arrangements, and…tissues that are difficult to study in other settings,” McKellar explained.

McKellar added, “This is a new source of information that is worth researching with intensity and protecting as a fossil resource.”

There have been a flurry of recent prehistoric finds lately. Last October, paleontologists discovered a brain tissue from a dinosaur. A man found the fossil in East Sussex, England in 2004 and after researching an object that looked more resembles a rock than brain, researchers discovered the fossil actually contained blood vessels, tissue, and other features found in the outer layer of the brain. David Norman, the researcher in the study, explained, “It’s not the entire brain — it’s just remarkable preservation of soft tissues you wouldn’t expect to have preserved.”

You Can Now Watch HBO on Google’s Daydream

On Tuesday, Google’s virtual reality headset, Google Daydream, announced a new set of applications available on the VR platform. The announcement, which was posted on the company’s website, revealed the launch of HBO Now, Lego games, NextVR and several other virtual reality applications. Google also announced Netflix will soon become available on the Daydream platform.

The HBO NOW app now allows HBO subscribers to watch movies and original TV shows in virtual reality. However, at the moment the video quality is not full-immersive 3-D virtual reality. But, HBO could be working on creating and developing VR content specifically for the growing virtual reality audience.

In addition to HBO NOW, Google’s Daydream released several new games including: Lego BrickHeadz Builder VR, Gunjack 2: End of Shift, Wands, Underworld Overlord, Layers of Fear: Solitude.

Google’s VR platform for Android is currently available on the Pixel phone but, many other phone manufacturers are expected to build upon Google’s virtual reality platform.

Outside of Google’s VR platform include Facebook’s Oculus Rift, HTC which announced on Tuesday the release of the Oculus Touch – a $199 package that includes controllers and a tracking camera that works alongside the $599 Oculus Rift.

The Oculus Touch controllers track the movements of a user’s hands along with providing buttons to increase interactivity. In fact, the sensors within the Oculus Touch allow for the computer to determine if a user is making hand movements such as pointing, shaking or even waving. Features that are not available on other major VR products. In addition, Oculus features well over 50 games. Far more than Google’s Daydream.

The biggest difference between Facebook’s Oculus Rift and Google’s Daydream, is that the Daydream View headset is not dependent upon computers or a specific manufacturer and the fact that the Daydream headset can be used by compatible smartphones making it cheaper than Facebook’s $599 VR headset.

Popularity for VR has grown substantially. According to reports, the number of search queries regarding VR has increased by nearly 400% percent in the past 12 months. In addition, a 2015 study by the Ericsson Consumerlab found that shopping was the main reason why smartphone users were interested in virtual reality; 64 percent said “seeing items in real size and form when shopping online” is the main reason for being interested in virtual reality.

Battery Problem Maybe Tip of the Iceberg for Apple

On Tuesday, Apple posted a response to battery issues related to the iPhone 6S which have gained much attention amongst social media users in China over the past month.  The statement which was posted on the company’s customer support page relegated the issue to a ‘small number of customers’.

However, the problem, which causes phones to shutdown to ‘protect its electronics’, may be much larger than originally anticipated.  According to reports, the phones in question were manufactured in the Fall of 2015 and the battery problem is due to a handling issue during assembly.   While the company is reportedly working on a software update to solve the issue, it is unclear how this will solve the problem.

Apple has remained relatively silent on the issue, which first surfaced on social media more than a month ago.   According to reports in the Wall Street Journal, a Shanghai-based consumer activist group with ties to the Chinese government is pressuring Apple to be more forthcoming about issue.

In addition to reports of battery failures leading to the phones shutting down, the Shanghai Consumer Council has also received complaints of iPhones spontaneously catching fire.  These complaints add to Apple’s woes in China and have rekindled fears following similar issues with Samsung’s Galaxy Note 7.

The Samsung phones were ultimately recalled after several countries banned their use due to public safety concerns.  While Apple has been quick to point out that the iPhone 6S battery problems do not pose a risk to consumers, many users in China remain skeptical.

China represents an important market for Apple as growth in high-end mobile phones has slowed in the U.S. and Europe. However, Apple has struggled to gain share in China in the face of strong local competition which includes the likes of Oppo, Huawei, and Xiaomi who have moved in the higher-end phones in recent years.  Many of these phones are more tailored for the needs of the Chinese market.

While Apple is facing growing concerns in China, initial reports indicate that U.S. sales of the iPhone 7 and 7 Plus grew at a faster rate than last year’s iPhone 6s.  Some analysts believe this may be due to the nature of iPhone releases as the company announces a completely new model in even numbered years with an incremental increase in odd numbered years.

Even though the jump in iPhone 7 sales has helped to move Apple’s market share in the U.S. market above 40% for the first time in years, Samsung still retains a dominant position with nearly 58% of all cell phones in the U.S.  As such it is unclear whether the jump in market share is a short-term phenomenon or an indication of Apple’s ability to win back share in its home market.

As of Thursday morning, in New York shares of Apple were trading up .72% at $111.83.

New FDA Ecstasy Approved Trial Could Help Soldiers Treat PTSD

The Food and Drug Administration approves new trials for Ecstasy as a treatment for PTSD.

On Tuesday, the Food and Drug Administration agreed to new trials for Ecstasy as relief for Post Traumatic Stress Disorder patients.

The Food and Drug Administration gave approval on Tuesday for a large-scale, Phase 3 clinical trial of the drug, which is the final step before the approval of Ecstasy as a prescription drug.  If successful, the new ecstasy trials could transform an illegal substance to an available treatment for those suffering from PTSD.

Post Traumatic Stress Disorder is a mental health condition that is caused by a stressful event. Symptoms include nightmares, severe anxiety, and panic attacks. A 2012 study found that patients suffering from PTSD reported a decrease in symptoms by nearly 60 percent. By the end of the study, more than 66 percent of the patients reported having PTSD.

It is important to point out that a recent study found that PTSD has quickly become a growing epidemic among American soldiers. In fact, The U.S. Department of Veterans Affairs believes that PTSD affects over 30 percent of Vietnam veterans, 10 percent of Desert Storm veterans, 11 percent of Iraqi war veterans.

In 2009, the U.S. House of Representatives Committee on Veterans’ Affairs held a panel discussing PTSD and how it has evolved over the decades. The committee called the meeting, “The Nexus Between Engaged In Combat With The Enemy And PTSD In An Era Of Changing Warfare Tactics.”  

Ian C. De Planque, assistant Director of Veterans Affairs and Rehabilitation Commission pointed out one of the biggest problems with PTSD and the VA is the the claims process.

Planque illustrates a story in which two soldiers, an infantry man and a mechanic both see a  horrific incident. But, because of their jobs and circumstances, after returning home from combat, the soldiers may receive different treatments despite reporting the same symptoms.

“They must prove that the alleged incident occurred.  Here is where the two soldiers are then treated differently,” Planque explains. “The first veteran, the infantryman, has a combat infantry badge.  As long as his story is consistent with the hardships and circumstances of combat, which we can all agree that it is, the VA cedes the existence of the event and a claim is granted.”

Meanwhile, the second veteran has no combat decoration and is forced to actually prove he has seen combat. In addition to suffering from PTSD. “This veteran must now prove several things happened.  He must prove that he was on the convoy.  This can be difficult. If not impossible,” Planque says.

With Donald Trump becoming the next President of the United States, Trump has outlined his plans to help veterans. According to Donald Trump’s Veterans Affairs Reform plan, Trump’s vision includes:

  • Ensure our veterans get the care they need wherever and whenever they need it. No more long drives. No more waiting backlogs. No more excessive red tape. Just the care and support they earned with their service to our country.
  • Support the whole veteran, not just their physical health care, but also by addressing their invisible wounds, investing in our service members’ post-active duty success, transforming the VA to meet the needs of 21st century service members, and better meeting the needs of our female veterans.
  • Make the VA great again by firing the corrupt and incompetent VA executives who let our veterans down, by modernizing the VA, and by empowering the doctors and nurses to ensure our veterans receive the best care available in a timely manner.

It is projected that by year 2017, the  number of active troops will be slightly more than 1,281,900 plus another 801,200 in seven reserve components; this is the lowest number of active troops since WWII. Also, the Department of Defense budget was $598.5 billion or 54% of our federal discretionary spending in 2015.

The number of active troops is important because it answers the basic question, how many fronts can the US afford to fight in at the same time? In addition, the number of active troops addresses this by factoring in how and when can troops be rotated in and out of a conflict – The stress of war can wear people down, mentally and physically, most notably, PTSD.

However, two of the biggest issues most Veteran Organizations have are the quality and speed of healthcare services Veterans receive. In 2015, a VA hospital in Phoenix, Arizona reported having more than 8,000 requests for health care and that many former soldiers had to wait longer than 90 days to receive any sort of care.

The U.S. government spent billions to fix the Veterans Health Administration and combat long wait-list times, a 2016 report found that the the agency still suffered serious problems. A Congressional committee in charge of trying to fix the Veterans Health Administration found “many profound deficiencies” at the government agency that “require urgent reform”. In addition, the commissioners argued, “America’s veterans deserve a better organized, high-performing health care system”.

Google Maps Briefly Identified Trump Tower as “Dump Tower”

Someone renamed Donald Trump’s midtown Manhattan building to “Dump Trump” on Google Maps.

Last week, Google Maps announced new features that will allow users to determine how busy a place is in real time. In addition, Google Maps added a new feature called “Areas of Interest”. On the Maps application users will now see “hot spots”. These are popular areas, calculated by Google’s algorithm. Since the 2016 Presidential election, one of the most popular areas in New York City is the Trump Tower.

But on Saturday, Google Map users discovered the Trump Tower had a new name. In fact, the Fifth Avenue Midtown Manhattan building was now called “Dump Tower”.

Google later corrected the “Dump Trump” name and changed it back to “Trump Tower”.

Trump Tower is a 58-story skyscraper located on Fifth Avenue between 56th and 57th streets in Midtown Manhattan, New York City. At the moment, Trump Tower is the headquarters for the Trump Organization and residence of U.S. President-elect Donald Trump. Trump Tower broke ground in 1979 and was completed four years later. Now, the Trump Tower features 13 office floors, 60 stories, and 40 condominium floors. Some of the world’s biggest celebrities, stores and athletes reside in the Trump Tower including: Bruce Willis, Cristiano Ronaldo, and Gucci’s flagship store. In addition, several famous celebrities used to live in the Trump tower such as Michael Jackson.

Since the 2016 presidential election results, the Trump Tower has become a focal point for protests against President-elect Donald Trump. Many celebrities including Madonna, Cher and Lady Gaga took part in protests against Donald Trump.

Donald Trump has not commented on “Dump Trump” but, recently focused his attention on the the pending Presidential election recount. Green Party’s Jill Stein announced a plan to review ballots in three swing states. Hillary Clinton’s campaign announced they would support Stein’s recount. Trump went on Twitter dismissing the recount.

Jill Stein filed a petition in Wisconsin on Friday to recount votes in the state. Donald Trump nearly defeated Democratic nominee Hillary Clinton by roughly 30,000 votes.
