The New York Jewish Coalition for Criminal Justice Reform (NYJCCJR) is proving that everyone possesses a basic right to spiritual reflection despite their circumstances. The group, made up of 29 Jewish associations from New York City, takes a weekly trip to Rikers Island. Here, they share prayers, songs, scriptures, and connect with those in custody awaiting trial. This visit is not just a spiritual respite for those in detention, but also a stark reminder of a human rights issue happening in our very city.

State of Affairs at Rikers

Rikers Island is home to people struggling with mental illness, poverty, and addiction. They wait months, sometimes years, for their trial to commence, with deteriorating mental and physical health. For some, they leave in worse shape than they arrived, facing homelessness, hospitalization, and possibly another jail term. All these happen against a backdrop of tired staff, crumbling buildings, and scant resources.

Rikers: New York’s Largest Mental Facility

Unsettlingly, Rikers acts as New York State’s biggest ad-hoc mental institution, accommodating 20% individuals diagnosed with severe mental illness. Despite the hefty price tag of over $500,000 per person yearly, residents grapple with violence, a fallout of facilities, lack of programs, and staff shortages. This interferes with their ability to access much-needed medical, mental health care, court dates, or even educational and legal services.

The Path to Closure and a Start to Remedies

Rikers is, however, set to shut down by 2027. The closure entails significantly reducing the jail population by investing in city-wide services such as work-release programs, mental health initiatives, and more. Expectedly, these resources need to be added to as soon as possible, rather than wait for the set 2027 timeline. This action will not just enhance safety, but also save New York City over $1 billion annually.

Inadequate Resources for Mental Healthcare

Despite such affirmative plans, the resources for mental healthcare are insufficient. For instance, Justice Impacted Supportive Housing (JISH), designed to reduce jail, shelter, and hospital populations, was expected to grow from 120 to 500 units. However, the low funding discouraged providers from applying. Fortunately, this year’s city budget included an extra $6.4 million to fund the existing 120 JISH units and create 380 more. Scaling up such resources could prove beneficial to those returning from Rikers.

Healing for All: The Need of the Hour

When the NYJCCJR meets those in Rikers, it prays for strength and healing for everyone affected: the ill, the vulnerable, victims of crime, and prisoners. Locking individuals up, particularly those with mental illness, addictions, or no home, for years without trials does more harm than good. It’s not safe, it’s harmful, costly, and regressive.

So What Can We Do?

In the wake of all these issues, what can be done? The NYJCCJR, led by Lissy and chaired by Rabbi Haber, forefronts a more compassionate approach. The focus is on extending care and healing to each other. Despite these perks, a proposed change may disrupt this complex relationship further. Plans are underway to shift the task of issuing film shoot permits. Currently, this is the duty of the Department of Small Business Services. The proposal suggests moving this responsibility to the Department of Information Technology and Telecommunications. The Mayor’s Office of Film and Television would still oversee the overall shot organization.

The Charter Revision Commission, responsible for the proposal, argues it would simplify the process. One reason is that the city’s broadcast license is already managed by the technology department. Film shoots, while exciting, can cause significant disruptions. In areas like Arthur Ave in Belmont – known as NYC’s Little Italy – they can even be disastrous. Many overlook the negative impacts of these disruptions on local business, including the loss of customers due to parking restrictions and unfriendly on-set staff. These negative impacts need to be factored into the decision-making process.

A Case for the Small Business Department

The department of small businesses has a unique understanding of the city’s diverse neighborhoods. They are equipped with liaisons who have clear lines of communication with organizations such as the Business Improvement Districts (BID).

For instance, shooting in Belmont is tricky. Despite the inconvenience, it’s manageable because there’s a possibility of negotiating terms with someone who comprehends our local needs. Little details like scheduling shoots on restaurant closure days or delaying shoots during festive seasons matter greatly, and the small business department understands these nuances.

Will the Technology Department Keep Up?

It’s unclear whether the technology department can match this level of local understanding. As tech-savvy as they might be, their grasp of local intricacies may not be as thorough, especially in the initial phases. This could lead to miscommunication or even worsen the situation.

Understanding Community Needs

At the end of the day, the crux of the matter is clear. While film shoots may benefit the city’s image and economy, they must not infrac on the rights and needs of local communities. Ensuring a healthy balance between the city’s commercial and residential identities is essential.

Creating a conducive environment for shoots — one that doesn’t hinder locals — can be a net positive. However, handing over control to a department lacking ground-level experience and connectivity might not yield adequate results.

Unfortunately, the enlistment of these laws has not guaranteed better staffing. Numerous nursing homes continue to operate with staffing levels below the required minimum, often with regulators’ approval or without any repercussions.

The Pursuit of Adequate Staffing

The Biden administration is currently trying to guarantee adequate staffing in nursing homes, similar to previous unsuccessful state attempts, through stricter standards. Federal rules set in April are likely to require four out of five homes to increase their staffing levels. Nonetheless, this plan has its weaknesses, including underfunded health inspectors for enforcement and a lack of explicit penalties for violations.

Impact of Covid-19 and Low Pay

The situation further deteriorated when the Covid-19 pandemic swept through nursing homes, claiming over 170,000 lives and driving employees away. Nursing assistants, who are among the lowest-paid employees in the industry, earning about $19 an hour on average, frequently opt for less strenuous jobs in retail and fast-food outlets that pay equally well. As a result, the turnover rate in nursing homes is alarmingly high.

The mostly for-profit industry puts the blame on reduced reimbursement rates by Medicaid for staffing issues. Nonetheless, research and court evidence suggest that nursing home owners and investors often make considerable profits that could be reinvested into better healthcare provision.
